This Waiver of Limited Liability is valid for all trips/destinations with the Lyric’s Destinations LLC. that you partake in from the day place your deposit and until the return from the destination.

Terms of the Waiver of Limited Liability

In signing the reverse of this form I (the member) RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Lyric’s Destinations LLC, its trustees, directors, agents or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or any relating to any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, while traveling to/in the international or domestic destination(s). I voluntary assume full responsibility for any risks of loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, while engaging in social activities or traveling to/in the international or domestic destination(s).

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THE REGISTRATION FORM ON THE REVERSE, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Terms & Conditions

Lyric’s Destinations, LLC which runs the LDTG as part of its program of activities. All trip/vacations (with the exception of most day-trips) are planned and organized by a dedicated in-house Travel Coordinator.

These are the standard booking conditions of Lyric’s Destinations

1. Agreement

By agreeing to partake in this event, you agree to accept the full Terms & Conditions (below) and Waiver of Limited Liability of Lyric’ Destinations.

2. Payment

Full deposit is required at the time of booking within this registration form.

For all trips that are planned, once a deposit has been made you will receive a confirmation of registration and final terms under of the payment agreement based on your elected choice. If payment is not paid when due, Lyric’s Destinations will be entitled to cancel the booking without notice.

3. Insurance

We believe that safety and enjoyment are equally important when traveling. It is therefore one of our terms and conditions of booking that you have adequate travel insurance in place before you travel; cover must include emergency medical expenses, personal accident and repatriation. In addition, we strongly recommend that you include baggage, personal liability and cancellation cover.

Lyric’s Destinations will provide this for you at an additional cost.

4. Health

Where relevant, see your doctor to ensure that you are not travelling against medical advice.

As stated in point 4, it is the traveler’s responsibility to arrange insurance for any medical/repatriation needs you may have while on a trip. You must take out insurance policy before you travel.

5. Departure point/time

It is your responsibility to leave ample time for your journey to the departure point. The time stated on your ticket is the time of departure; you should ensure you are at the departure point three hours before an international flight and two hours for domestic flight. We cannot refund or rebook for you missing trips as a result of missing your departure time.

6. Travel Documentation

You are responsible for ensuring that you are in possession of the required travel documentation such as visas and passports and that they are valid and effective for all countries that you intend to visit. We cannot be held responsible for expenses incurred if travel documentation does not meet the required criteria. If you are in doubt, please contact the relevant embassy or LDTG travel coordinator. A valid passport is required for all journeys between countries for all nationalities.

US Citizens

Citizens of the United States do not require a passport for travel within the United States, however, participants must check with the relevant embassy before traveling. Requirements may change and you must check the up-to-date position in good time before departure.

All other Nationalities

Citizens of other countries should carefully check requirements for passports, visas and other documentation required for travel to your destination. Information can be found from the relevant embassy.

Lyric’s Destinations is NOT able to make refunds to participants unable to travel through failure to comply with immigration regulations. You should apply for your visa at the earliest opportunity as it can be a slow process. LDTG will provide a letter of information (detailing flights, accommodation, payment and support) for your visa application, once you have paid in full for the trip.

For all trips we ask that you bring the travel documents, insurance and other information provided by Lyric’s Destinations at final payment.

7. Refund & Cancellation policy

A full deposit is due at the time of booking. the initial deposit and cost for travel insurance is not refundable.

If you cannot travel, please inform Lyric’s Destinations. immediately.

If you fail to inform us that you cannot travel you may be subject to a fine equivalent to the subsidy LDTG has paid on the trip.

In the unlikely event your trip is cancelled by Lyric’s Destinations. or one of our suppliers because of unusual or unforeseen circumstance beyond our control, then we will receive a full refund you the price paid for the trip, but you will not be entitled to any compensation for the loss of the vacation/tour.

8. Variation of brochure

We reserve the right, before you book, to vary the services described in the brochures, including departure dates and characteristics and categories of transport/accommodation. You will be notified of any changes before traveling.

9. Alterations

After you book, it may occasionally be necessary to change the itinerary at the last minute, perhaps because of weather conditions, last minute closures or travel delays, for example. Please be patient and adopt a flexible approach. Any change in content will be made on a like for like basis. All final content of the trip will be emailed to you one week prior to departure for day trips organized by LDTG and two weeks prior to departure for overnight trips, listing final accommodation, transport times, scheduled activities etc.

10. Behavior

You will be responsible for the conduct of yourself and you will indemnify us against any liability for damage caused by you. We ask you to participate fully in the trip and be considerate towards the whole group – the more you get involved the more fun you will have.

We ask that you take reasonable care of your own and others’ health and safety, carry out activities in accordance with instructions, and co-operate with the Group Leader in an emergency.

11. Complaints / Compliments

Should you have a problem during your tour, please contact your Group Leader at the time and they will do their best to rectify the situation. If we are unable to resolve your complaint at the time you can contact the Travel Coordinator.

To help us to continue to improve, we ask all participants on our trips to complete a questionnaire at the end of the trip. Your travel coordinator will organize this.

12. PANDEMIC/EPIDEMIC

As the world wide COVID-19 coronavirus pandemic remains ongoing at this time, I acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, these travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity or other third party over which Agency has no control. I further acknowledge that the supplier’s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern my rights and remedies, including my right to receive a refund, in such an event. Moreover, I understand that should I elect to purchase travel insurance, the terms of the policy will dictate whether, and what extent, coverage for any financial loss may exist under the circumstances. I hereby agree to hold Agency harmless and release it from any and all liability for any damages, including but not limited to monetary losses, I may incur as a result of such interruption or cancellation of these travel plans.

13. ENERGY ANGEL RELEASE FROM LIABILITY

I understand that my participation in nutrition coaching, fitness and/or any dance exercise fitness program thereof and any participation of fitness classes therein may involve risk, including, but not limited to sprains, pulled muscles, aches and pains and overall general soreness. I also understand that any instruction or coaching provided is intended only to guide me in proper nutrition, fitness form and technique. It is put to me to monitor my own intensity levels and; medical condition and to make my own determination concerning the appropriate level of activity based on my physical health. I understand that any questions concerning my ability to participate should be discussed with my physician. I am in good health and I have informed my doctor of starting this fitness and nutrition program and have been cleared to participate. I do not have any medical conditions, such as heart disease, asthma, hypertension or diabetes that may interfere with my use of the facility and participation in Fitness/Dance classes. I have been advised to seek competent medical advice before I follow any regiment of nutritional adjustment and/or exercise. Based upon the foregoing and my desire to utilize this program/event/services, I hereby release The Energy Angel, lLS, Angela W Maske, the faculty and instructors conducting the classes/coaching thereof; and assign from any and all liabilities and/or claims arising from, or in any way connected with, my use of participation of the program/facility or an extension thereof. This has been fully explained to me. I also understand there will be no supervision of my workouts other than the instruction/coaching of the Fitness/Dance class coach/instructor and that I assume the risk and responsibility of my fitness level and will adjust to fit my abilities accordingly. The attendee grants The Energy Angel, LLC permission to use his/her likeness (including minor children) in photography and/or video in any and all publications and materials without payment or consideration made to them. The attendee realizes these photos and/or videos become the property of The Energy Angel, LLC and will not be returned. The attendee authorizes The Energy Angel, LCC and Lyrics Destinations Travel Group LLC to edit, copy, publish or exhibit any photo or video for any lawful purpose. The attendee waives the right to review any photo or video or to obtain royalties from the photo or video. Please note: Photos and videos will be taken throughout the event and some photos/videos will be posted/published. I am participating in The Energy Angel Fitness & Nutrition programs of my own free will, with knowledge of all that it entails and I am responsible for my own activities and consequences of those actions.
